Pregnancy discrimination occurs when your employer treats you differently because you are pregnant or they believe you may be pregnant. Courts will look at how the employer treated other employees who were not pregnant and compare that to the treatment you suffered. If, for example, a similarly qualified employee receives a promotion that you applied for and the only discernible difference between you two is that you were pregnant and the other person is not, you may have a viable claim for pregnancy discrimination.
